By engaging FleckUniverse to provide the Aria AI receptionist service, or by using fleckuniverse.com, you agree to these Terms of Service.
FleckUniverse provides Aria, an AI receptionist service for New Zealand real estate agents and agencies. Aria can answer inbound calls — handling buyer and seller enquiries, listing and open-home questions, lead qualification, and appointment booking — and, where a client agent wants it, can also make outbound follow-up calls to leads. The exact configuration is agreed with each client during setup.
This service is intended for real estate agents and agencies operating in New Zealand.
If you are a real estate agent or agency using Aria, you’re responsible for:
Fees for the Aria service are agreed with you individually during setup and are billed monthly in advance by card or bank transfer, unless we agree otherwise in writing. If a payment fails or is missed, we’ll contact you to resolve it before suspending the service.
In addition to the recurring service fee, you’re responsible for usage credits, which you purchase separately on a pay-as-you-go basis to cover Aria’s call usage. If your usage credits run out, Aria will pause answering calls on your number until more credits are purchased — you won’t be charged automatically for going over.
This service runs on a month-to-month basis unless otherwise agreed in writing. Either party may cancel with 30 days’ written notice. Any one-off setup fee is non-refundable once setup work has begun.
Aria is an AI system. While designed to answer accurately using the information provided by each client agent, Aria’s responses may occasionally be incomplete or incorrect, and Aria does not provide legal, financial or professional real estate advice. Client agents and their customers should independently verify any information that is time-sensitive or important before relying on it.
FleckUniverse retains ownership of the Aria platform, scripts, prompts and related material. Client agents retain ownership of their own listing content, branding and customer data provided to configure the service.
To the maximum extent permitted by law, FleckUniverse’s total liability to you arising out of or in connection with the service is limited to the fees you paid us in the three months before the event giving rise to the claim. FleckUniverse is not liable for any indirect, consequential or special loss, including lost profits or lost business opportunities, arising from your use of the service.
Nothing in these terms excludes, restricts or modifies any rights you have under the Fair Trading Act 1986 or Consumer Guarantees Act 1993 that cannot lawfully be excluded.
Each party agrees to keep the other’s confidential business information private, and to use it only for the purposes of providing or receiving the service.
These terms are governed by the laws of New Zealand, and any dispute is subject to the non-exclusive jurisdiction of the New Zealand courts.
We may update these Terms of Service from time to time. Continued use of the service after an update means you accept the revised terms.
